Doctrine of Discovery

 In the 1823 Supreme Court decision Johnson v. M’Intosh, the Court declared that the doctrine of discovery—the notion that whoever finds a land through colonization can claim it—can be applied to Native Peoples’ territories. Have students research the broader issue of land rights in Native Peoples history and explain how these issues relate to the concepts of rights and responsibilities.
